Welcome to Obi-Hub ("Platform", "we", "us", or "our"), operated by Palmr Style & Co LLC d/b/a Threadbird, located at 7550 Brokerage Dr, Orlando, FL 32809. By accessing or using our website at obi-hub.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

1. Description of Service

Obi-Hub is a software-as-a-service (SaaS) platform designed for clothing brands to manage their operations, products, and digital assets. The Platform allows users to create accounts, invite team members, upload files, and manage brand data.

2. Account Registration and Security

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately at support@obi-hub.app if you suspect any unauthorized use of your account.

3. Subscriptions, Billing, and Storage

Subscriptions: Obi-Hub offers various subscription tiers. By selecting a paid tier, you agree to pay the monthly or annual subscription fees indicated at the time of purchase.

Storage Limits and Add-ons: Each tier includes a specific storage limit. If you exceed this limit, you may be required to purchase additional storage add-ons or upgrade your tier to continue uploading files.

Billing and Renewals: Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date. Payments are processed securely via Stripe.

Refunds: We offer a 30-day money-back guarantee. If you are not satisfied with the Platform, you may request a full refund within 30 days of your initial purchase by contacting support@obi-hub.app. Please review our Refund Policy for more details.

4. User Content and Intellectual Property

Your Content: You retain all ownership rights to the designs, photos, tech packs, and other files you upload to Obi-Hub ("User Content"). We claim no ownership over your User Content.

License to Us: By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your content solely for the purpose of providing the Platform to you and your authorized team members.

Our Intellectual Property: The Obi-Hub Platform, including its code, design, interface, and branding, is owned by Palmr Style & Co LLC and is protected by copyright and intellectual property laws. You may not copy, modify, or distribute our intellectual property without our express written consent.

5. Acceptable Use

You agree not to use the Platform to upload, store, or share any content that is illegal, infringes on third-party intellectual property rights, contains malware, or violates our Acceptable Use Policy. We reserve the right to remove any content or terminate accounts that violate these rules.

6. Termination

You may cancel your subscription and close your account at any time through your account settings. Upon termination, you will lose access to the Platform, and we may delete your User Content in accordance with our data retention policies. We reserve the right to suspend or terminate your access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

7. Limitation of Liability and Disclaimers

"AS IS" Basis: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Platform.

Limitation of Liability: To the maximum extent permitted by law, Palmr Style & Co LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of your use of or inability to use the Platform.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Orange County, Florida.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms.
